Home Health Care and Residential Care
As of January 1, 2015 the regulations regarding Home Health Care and Residential Care (Companionship Services) changed dramatically. The new rules bring important minimum wage and overtime protection the for home health care and residential health care workers. Home Care agencies are no longer able to claim the companionship or live-in exemptions. Instead, employees of home care agencies will be entitled to minimum wage for all hours worked and overtime (one and on-half times the regular rate of pay) for hours worked in excess of forty (40) in a workweek.
